Legal Question in Family Law in California

Can my exhusbands new wife legally serve me custody hearing papers or is she considered a party to the action? She has been deposed in this case 6 years ago.

If she if not a actual party to the case then yes. Any non party can serve documents.

She can serve papers unless she is named as a protected party in any restraining orders. It does sound tacky though, but not clearly illegal.
