Legal Question in Family Law in California

Family Law

What steps do I take to have the Judge in my Custody case replaced with a new Judge? The Judge in my case is also the Judge in my new husbands custody case. He has mentioned my husbands case during mine and mine during my husbands case. Is this ethical? He isn't suppose to consider the two cases together, is he? Is this enough of a reason to have him disqualified?

Re: Family Law

Based on your statement it is too late to replace the judge unless you can show prejudice. As to the judges comments it would depend upon what is being said. You should discuss this with your attorney if you do not have an attorney consider retaining an attorney. You could also file a complaint with the council on judicial performance.
