Father hides & condones son's drug use

I recently learned my 16-year-old son's father has been covering up for our son's marijuana use. I have sole physical & legal custody. Dad abandoned our son after divorce 12 years ago (no child support/contact) and reappeared when our son was age 13. Dad has told me he has been drug-testing our son when in fact he has not. Dad gives our son advice on how to hide his drug use and has been undermining my attempts to get our son into a rehab program. At this point I am the devil and dad is the hero - my son blatantly refusees to go into the drug diversion program I am demanding he aettend. Are dad's actions a form of child abuse? Do I have any legal recourse?

it is called child endangerment and it is a crime.
