Legal Question in Family Law in California

I filed for divorce back in he 90's, he was served the papers, but that was the last I ever heard about it until I was looking at the case index in myself and came across a dissolution of marriage.The case file has me divorcing my son. My ex and my son have the same first and last name but different middle names. Am I divorced? How do I fix this?

The first thing that you must consider is whether or not the court on its own motion dismissed your family law matter since no answer was filed and no further action was taken. The court has the power to do that after five years of the case not proceeding.

If the case is still active, you should amend the petition and re-serve the document on your husband properly naming him as the respondent. Please meet with an experienced family law attorney to explore all of your legal options.
