how do i get gaurdianship of a child when their gaurdian dies

If you and the child reside in California, you can petition the probate court in the county where you and the child reisde to become a minor's guardian. However, the child must reside with you and you must meet the necessary character and background checks. There are costs involved in filing and obtaining the necessary background checks. Most counties in California have guardianship programs through the local bar association that will provide advice if you cannot afford to retain counsel. You can also obatin financial waivers of the filing fees if you cannot afford them. Good luck.
