Legal Question in Family Law in California

Hello,

I have a child custody question? I'm the mother of a five year old girl, who lived with me until the age of 31/2. To live with her father in Sacramento, that county has jurisdiction. Our daughter started Kindergarden this year. And her father has taken her out of school for the second time for weeks at a time, and this time I have her in stead of his wife's in-laws, because I now live in Southern california. I don't know where he is or exactly how long he'll be gone. Can I file a ex-parte hearing to gain tempory custody?

Yes. I agree with Ms. Kock's advice. Since Sacramento has jurisdiction that is where you will have to file the ex parte. I suggest you use one of the family law facilitator's offices to assist you with the documents. They are extremely helpful and generally know their stuff. Sacramento's office is very busy. I volunteered in the Placer county facilitator's office for a few years and they would assist people from other counties. They are very close to Sacramento only about 20 miles away and It would be well worth the drive to seek out their guidance with the documents. They help a lot of people from Sacramento county. Also in El Dorado County the law library has para-legal and attorney volunteers that assist people on certain days. They will help people from other counties as well. I'm not sure what days they are available but call the El Dorado County law library and they will let you know. They also hold clinics on custody.
