Legal Question in Family Law in California

Hello,

We are in Placer county, California and I would like to know:

Generally speaking, does the non custodial parent have to pay daycare expenses to the custodial parent if it is so the custodial parent can work? The current custody order states the father will pay $1000 in child support and 50% of the child care expenses.

The mother no longer gets along with the staff at the school child care facility and is seeking private child care which will be more costly. The father is planning on revisiting the child support order since he has had two more children and the mother has gone back to work full time. Also, please suggest any articles or websites regarding family law that you believe would be helpful to me. Thank you for your help and time.

It is standard for both parents to pay 50% of child care because it is the intention of the custody and support system that both parents work or look for work to support the children of the marriage. You definitely should seek a modification of the custody and support order if you have any material change in circumstances. Either parent having additional children from a new relationship and one parent going to work full time when the existing order is based on part time or non-working, are both major changes that qualify for a child support revision.
