Legal Question in Family Law in California

Hi

I went to mediation several months ago for a divorce. Papers were filed and a summons was given to my wife. She doesn't want the divorce and now I can't decide if I do. I was wondering what happens to the filing. If there is a limit of time as to when the filing would go away or if it stays filed indefinitely.

It depends on where your case is procedurally. If you have a Case Management Conference or similar hearing on calendar and you fail to appear, the Court will set the matter for an Order to Show Cause regarding Dismissal. If you don't appear at that hearing, then the Court will dismiss the case. If you don't have any upcoming hearings, the Court will not just dismiss your case on its own.
