Legal Question in Family Law in California

home equity

My husband has drained our 50000 home equity account and now wants to refinance the house to obtain more money, I want him to sign a postnuptual agreement for my protection, so he would be deducting these funds from his half of the assets in case of our divorce; however I don't know if this will stand up in California?
