My now husband wants 2 adopt my three year old son. does the biological father have to be involved?

If legal paternity has been established, by declaration of paternity or by legal proceeding, then yes, he must be involved and generally has to consent. If there is no legal father of record, I think you may have to notify him but his rights are considerably less.
