Legal Question in Family Law in California

My husband and I are divorciing and he wants the 10% that he put down on the home, since the deeds show a fifty fifty ownership does he have rights to this amount? Also, (we both reside in home which is in default) I am unemployeed and he has refused to pay any of the house payment but will not sign to sale the home because of the settlement that I have requested in the divorce, what can I do?

If he made a down payment from his separate property funds, he may be entitled to reimbursement of this amount, unless he waived his right to reimbursement in writing.

Mr. Roach is correct. If the down payment was from separate property he is entitled to a 2640 reimbursement. As for the rest of it, you obviously do not know anything about your rights and remedies in this case. You need an attorney, and I rarely say that. I much prefer to help people help themselves. But when your house is at stake and you clearly don't know what to do, a lawyer is your only chance.
