Husband wants full physical custody- or does he?

My husband of 17y. moved out 11 months ago. We have 2 teenage girls that have been with me the whole time although he visits reg. We try to get back together but have huge fights and he recently called the police citing harassment against me. No charges pressed. I called on him a week ago because he slashed my tire. No arrests yet. We've decided to divorce. He has a friend that's a paralegal who he wants to do the paperwork for us so we can take it to a mediator. Yesterday, the paralegal served me papers FL-301 motion for custody- stating he wants full physical custody and me to get weekends and one weekday.It sounds like he wants the house too. I flipped out on him and he said his friend advised it because in case i end up getting arrested, then the kids won't have to go thru CPS garbage and that he doesn't want full custody of the kids. I told him as the father, they have no reason to deny you your children. He said since he hasn't lived with them it could happen. Sounds like crap to me. Sounds like he wants me out on the street and him back at home with the kids? Any suggestions? I am seeing an attorney this week.

Dicusss this with your attorney and follow the advice you receive. Do not discuss legal tatics with him. His statements about your being locked up indicate that he has something in mind to trap you into committing an act of violence, or some other act to get you put into jail.
