Legal Question in Family Law in California

My ex husband who lives in nevada filed custudy papers and told the judge he had no way of contacting me which is a lie he has my contact info. So he put an ad in the newspaper and I had no knewledge of the court date so I defaulted. Now he's threating me saying the courts are going to take my daughter away. I filed custudy papers in california the state were me and my daughter have lived for over a year. The court date isn't until the end of october Can the courts take my daughter away? Can they take her from school grounds?

It depends on what the Nevada order says. His action in Nevada was illegal on a lot of levels, but until you get the truth before the Nevada judge, you could have real problems. You need to contact a Nevada family law attorney in the county where he filed and get the Nevada proceeding thrown out, right away. Otherwise the California authorities are going to believe the Nevada order is proper and enforce it.
