My husband and I got married before his previous marriage (divorce) was final. We've been married for 13 years now. Are we legally married? We have 3 kids.

Nope. Your are not legally married. You may be a putative spouse, however, but I agree with Mr. Johnson and that you should get married, after making sure the divorce from the prior is final.
