Legal Question in Family Law in California

Me and my husband have been married 5 yrs and together for 7 3weeks ago he left and never came back after about 4 days of no contact I reached him and he said he was done with me later that day I found out he is living with another woman who is 15 yrs older.he is sleeping with her she is his girlfriend. We have am5 yr old daughter and I'm 7 months pregnant, he says he wants his daughter but hasn't made much effort he has seen her 3 times in the last 3 weeks a hr or less each time. Can I sue him for desertion and or adultery? Can I sue the woman for breaking up a family and sleeping with a married man? What are my options?

Your option is to fie for divorce and consider filing a motion to request exclusive occupancy of your home with the children, child support and spousal support.

Ms. Kock is correct. Those are your only remedies. California (and most other states) did away with all laws that allowed people to sue over things like adultery more than 50 years ago.
