Legal Question in Family Law in California

My husband received a restraining order today with orders to stay away from child care provider which is the baby's godparent my husband and I just spoke to her about making arrangements to pick up the 5 year old boy, and she told my husband she has no problem with my husband picking him up and that he has just as much rights as the mother does also she said what goes on between you two is between you guys. will I his wife get in trouble if I go to the godmother's home and talk to her and ask her about the truth and record her without her knowing and as I'm walking away tell her that our conversation was being recorded.
