If a individual file a domestic violence restraining order against you and checks you too date but in the declaration says you never dated( which is true) does the case gets dropped?

That depends on whether your relationship to the other person falls under one of the other categories of "Domestic" for purposes of the statute. If not, you can request that the case be dismissed without prejudice to refile it as a simple civil harassment or other TRO.
