Kicking my boyfriend out

My boyfriend and I have a 14 month old together and I work 2 jobs to support the 3 of us. He stays home with our son because he hurt his back at work 2 years ago, he is no longer receiving money and I can't afford to take care of him anymore and he refuses to get a job. He told me that he was going to take our son over 400 miles away to live with his parents. My question is he considered the primary caregiver even though without the help of someone else he wouldnt be able to take our son anywhere (he has no license either)? I know that I can keep him from leaving with our son because he isn't on the birth certificate, but if this goes to court will the courts take him from me who provides for him to give him to his dad because he is considered his primary caregiver?

This is a difficult situation. Because he stayed home and cared for the child he would be the primary care giver. There may be other circumstances and factors that would be favorable to you. Consult with an attorney
