Legal Question in Family Law in California

Is there a law(s) and if so, what is it for protecting a relationship of 2 years, where one person is 17 and the other just turned 18 from a file of rape or some sort.

( 17 year old will be turning 18, 6 months later)

No it can be charged as statutory rape But considering the age of the parties the District attorney may use discretion and not charge it.
