Legal Question in Family Law in California

I am leaving my wife end of next month. We have a 3 yrd old son together. I have decided to take him with me to my parents house nearby. Where he can be cared for, while I find a new place to call home. Are there any legal ramifications to worry about? Or is it safer to file something with the local court in order to protect my self?

Right now, you both have rights to your son. If you do take your son, you will need to make sure that your wife has knowledge of where your son is. She also has the right to visit with the child, and she probably will file for custody. If you really think that custody with you is in the best interest of the minor child, then you should have an attorney file for divorce and ask for custody.
