Is it legal for your spouse that you are divorcing and have a restraining order against to hire a private investigator to stake out where you live and follow you or your family members?

It is legal so long as the PI does not violate the restraining order. It is illegal to get someone to violate a restraining order for you, but it is not illegal to investigate someone just because they have a restraining order against you.
