Legal Question in Family Law in California

legal time frame

My husband will not get back from deployment until mid Aug. Both of us want a divorce and want to speed things along. I do not want to stay in California, we have family and friends in OH and GA. How long can we expect this process to take once he gets back and what can we do to prepare while he is gone? I am aware of the soldiers and sailors act. I'm not receiving any help as far as information from base legal. Thank you for your time

Re: legal time frame

This can be handled very quickly once he has returned, depending upon the issues. If there are no children and not property then there is no reason why you would need to stay in California awaiting his return. I suggest that you sit down with an attorney to discuss your options. I think you will sleep better at night. Good Luck, Pat McCrary

If he is in agreement you can do the divorce now even though he's deployed. I have usually been able to email documents to servicemen, no problem. Once the case is pending, you are free to move.

Re: legal time frame

You may be eligible for a summary dissolution which would take six months for an oder. Contact me directly.
