Nobody can predict move away cases. If you are planning on moving away you need to file a petition for a move away well in advance of your intended move so the court can resolve the issue. Especially if you anticipate the other party not willing to agree to the move away. When a parent has joint custody, then the person intending to move away would need to convince the court that the move away would be in the child's best interests.

For self represented individuals you can consult with the family law facilitator self help center at your local court house.

As always please consult a local attorney prior to taking legal action. Good luck. Also please check out my Santa Clara County Family Lawyer blog.
