Legal Question in Family Law in California

I lived with my daughter an 3 grandchildren for 3 years while she battled cancer. She passed away July 2017. Their father had joint custody with my daughter. They were divorced for 6 years. He is making it near impossible for me to have time with the children and agreed thru therapy that I get them 2 days a week. Is there any chance I can file for joint custody? These kids are 9,11 and 14. Now he is moving them out of a great school district and agreed to move where I recently moved to. Now he is not moving here.
