Legal Question in Family Law in California

maintenance of husband

Divorce situation. I am 65 years old, low income, low salary. Wife is a professional with good retirement. Can I ask for espousal maintenance to keep same standard of living that I am used to?

Maybe. If you have been married more than 10 years, you can ask for up to 36 months of spousal support; longer if you are disabled. You can also request it during the pendency of the divorce. Your particular facts, as presented to the court, will determine if support is awarded, since it is not automatic.

I suggest you speak with a California family law attorney. The laws of California are very different from Texas laws. You might get a better deal there if your spouse lives in California.
