Marital Rights

Is there any way of having my wife commited to an alcohol rehab. center without her consent? She is living on the streets. We have a 3 month old daughter, and she has left her with my mother in-law. I also want to know if i have the legal right to go get my daughter. I am living in Washington State. C.P.S. has given my mother in-law temp. custody, without contacting me first. I am willing to take care of my daughter. Shouldn't I be the first candidate for custody of my own child? We are still married, and will continue to be, if she will get some kind of help.

Normally the other parent has a superior right. However, they must offer re-unification services to mom, in this case. That cannot be done if the child is moved to Washington. You should contact the juvenile court and request notice of hearings and an opportunity to be present.
