Legal Question in Family Law in California

Is my Marriage Legal?

I was married in a Civil Ceremony ( San Diego CA) in 1987. We live together until 1999. There was never a Marriage Cert. filed with the County of San Diego. We are now seperated and looking at divorce. Are we legally married?

Re: Is my Marriage Legal?

Maybe. You did not say where the civil ceremony was held or who did it, so again the best idea is to play it safe: do as much investigation as you can, see a lawyer if you have to and have some documentation stating the mariage either never existed or get a divorce if necessary.

Re: Is my Marriage Legal?

Maybe not, but you may have a "putative marriage" which would give you many of the same rights and responsibilities. See an attorney to give him more detail. If you plan to remarry, file a dissolution action, it is better to be safe than sorry. Good Luck, Pat McCrary
