Legal Question in Family Law in California
I currently married and pregnant...but the father is not my husband, and we have not filed for divorce yet, on the birth certificate, can i put the fathers name even though I am currently married to someone else?

Only if the biological father will come to the hosptial while you and the baby are still there and both of you sign a declaration of paternity form that the hospital will have available. Otherwise your husband is the legally presumptive father and it will take a court order to change that.
