Legal Question in Family Law in California

I have been married for a year and it is not working out. We had her kids name changed to my last name. Will I have to pay child support if we get a divorce?

Unless you legally adopted the children you would not have to pay child support. However there may be an issue of estoppel if the kids have become attached to you and believe you to be the father and you acted as if you would support the children then you may be responsible.

For self represented individuals you can consult with the family law facilitator self help center at your local court house.

As always please consult a local attorney prior to taking legal action. Good luck. Also please check out my Santa Clara County Family Lawyer blog.
