Legal Question in Family Law in California

If you are living in CA now, you can get a divorce in CA, but your will need 6 months of continuous residency to establish your right to petition your local county court for divorce. You will need a New York process server to serve the CA divorce documents on your spouse.

Mr. Tuan is correct here. Once you have six months of continuous residency in California and four months in any one county, you can file for divorce in California in that county. If there are children involved, they must have lived in California and that county as well. Where you start depends on whether you think you can do this your self or need an attorney. I suggest picking up a copy of Nolo Press' book entitled "How to Do Your Own Divorce In California." Even if you decide to hire an attorney it will help you understand the process. Look through the book and see if you think you can do it yourself. If you have doubts, you can find an attorney such as myself who will either take your case, or will offer you a "limited scope representation" in which we help you represent yourself. Whether limited scope would be appropriate would be a topic for you and the attorney you select to determine together.

I'd at least consult with an attorney. You don't provide any facts as to children, or residency, but the two previous attorneys begin advising you based on the assumption that you did. For all I know, you may qualify for summary dissolution.
