Legal Question in Family Law in California

Medical and Dental coverage

I understand that non-custodial parent have to have medical and dental coverage for the children.

But for orthodontic (braces) service ,does the Non-custodial parent have to pay or it should be shared between both custodial and non custodial parent?

Thanks

Re: Medical and Dental coverage

Most of the time medical expenses in addition to basic medical and dental coverage are split 50/50 between both parents. However, it depends on what is outlined in the Marriage Settlement Agreement. If nothing is stated and an agreement cannot be reached than and Order to Show Cause needs to be filed so the court can enter an order regarding additional medical expenses.

Good luck. If you need additional information please feel free to email me directly.

Re: Medical and Dental coverage

California law requires a parent to provide medical etc insurance for his or her child if that insurance is available at a reasonable cost through the parents employment.
