Legal Question in Family Law in California

modifying child support

My son is 18 and still in high school until June. I will continue paying until June but how do I start the process to stop the automatic deduction from my paycheck by June?

Reply: modifying child support

You need an amended Order Assinging Wages setting the child support amount to $0.

This can be done by your attorney or by a qualified paralegal assistant.

Good luck to you.

Re: modifying child support

First, ask your employer what they need. They may accept a letter from the mother. If they require an order ask the mother to sign a stipulation stopping the order. If neither of those work, go to the court house and ask the facilitator's office to assist you in preparing a motion to modify the support and terminate the wage assignment. Get the hearing date set close to the time of the graduation. Finally, if that doesn't work, hire an attorney. Good Luck, Pat McCrary
