Legal Question in Family Law in California

Hi, a few months a go I found out my husband took this woman to a hotel/casino, I like to know if we can check the security tape to see what time they entered and left the casino? or we could have the entire tape for that day? this was in August 09. Also if we can look her credit card info to see if there was a room under her name? and my last question can we check her phone records to see if she has been in touch with him at work? please advise. Thanks

You can probably get some or all of that information if it is relevant to a pending lawsuit, but not otherwise. As Mr. Cohen noted, however, you don't have to have any cause for divorce in California other than you have "irreconcileable differences," in other words you just have to say you don't get along anymore and never will. So adultery is irrelevant. I can't think of what other kind of lawsuit you might bring that the information you want would be relevant to. So the answer is probably, "No, you can't get that information, because it is not legally relevant to anything."
