Legal Question in Family Law in California

Mother Withholding Child in Contempt of Consent Order re Visitation

The mother of the child is withholding the child from visitation with father by simply not showing up on the father's designated weekend. The father has served papers on the mother to get back in front of the judge, and notifies the police each weekend that the mother is in contempt of the visitation order (this has been going on for about one month). The court has not notified him of the hearing date. What is the father supposed to do in the mean time?

It is difficult to answer your questions without first knowing what pleadings you filed. At some point, if this conduct continues, you may have to seek a change of custody. It is important to document all of the times that she violates the Court Order.

Good luck to you!
