Can I move to another state with my daughter?

I have sole physical custody and joint legal custody of my daughter. My daughter's father will not give me permission to leave the state with my daughter; however, my current husband needs to make a decision on a new job he has been offered. Do I have to wait for her dad's permission to make our move? Am I able to get the court's permission on my own?

You should immediately retain an attorney and file a motion requesting a court order allowing you to move to the another state. As a part of that motion you should point out the amount of contact between father and child. Also present a plan for father to have visitation after you move.

In a general sense, if the other parent will not consent to the move, and assuming you need the other parents consent, you will have to bring the issue Court to obtain a Court Order.
