Legal Question in Family Law in California

I moved out of the county my kids were born in, initially I worked there and after 2 years having full custody because the father had no job and no car he was awarded 50% after obtaining work. I had been arrested for embezzlement and have a new job out of that county, I plead quilty do to a missunderstanding which I am fighting. The father has been unemployed now for a year and again no job, however he lives in the town the kids have always went to school in, i am now having to pay alot in child support since he is working. What are my chances of getting custody and moving them to a new school with these factors? My children are 12 and 10.

The parenting timeshare is driven by what is in the child's best interests. If fathers living situation is bad for the children, then there may be a reason to shift a greater timeshare to you.
