Legal Question in Family Law in California

NCP trying to avoid paying CS

CA. 5mths ago, I was awarded DVRO from NCP. Attached was a stipulation that states: visitation time for NCP, and sole custody for me. NCP failed to follow visitation so it was reduced automatically as stated. He didn't care. I went as far as dropping our son at this home on his alternate weekends. I filed for CS 1mth ago. Since he learned about the CS, he has threaten me to destroy my teaching career, call CPS on me, and has hired a lawyer to obtain full custody of son, and claims I will pay him CS. He has since, picked up son and told him that I filed for CS. In order for son to go with him, he promised computer games, he took him to zoo- and more things. he promised more things if he went next weekend. Teenagers are materialistic, and NCP knows what he is doing to son. I have been the only one to take responsabilities in sons education, doctor visits, sports...I always asked NCP to help, but he refused. What are his chances of obtaining joint/full custody of son? What about status quo? How can I play my strengths in court, do I need a lawyer? What will his lawyer try to prove in court? Do I need to prove anything to judge? Will the fact that i just applied for CS be a factor anddad suddenly wanting Custody? How can I help muself?

Re: NCP trying to avoid paying CS

You are entitled to child support, but both parents have rights. Given what you have written, past behavior is on your side, but you need to retain counsel to fully protect your rights and obtain a reasonable result. If you give an inch, he'll take a mile. Stand up for yourself without further delay -- if not for you, for your teenage son. Please let me know if I may be of further assistance.
