Legal Question in Family Law in California

my niece moved to no. CA 7 weeks ago. She took her 3 yr. old son from so. CA where he was staying, between his grandparents & father, this past Saturday & returned to no. CA. She moved there for work and to find a better life for herself, her son, and current husband. She was never married to her son's father. She filed custody against the father in her local court & he did the same (he retained a lawyer & she did not). His atty. left a voicemail today on her cell telling her she needs to be in court at 8:30am tomorrow. However, she cannot go to this court in so. CA because she has no transportation and her hearing against the father is scheduled for custody tomorrow at 1pm. She could not get through to anyone at the so. CA courthouse and left numerous messages. Can she request a telephone hearing tomorrow? Does she need to fax the documents she filed to his lawyer and to the so. CA court? What happens at this point and do the judges communicate between themselves on this case?

As was stated in the area where you posted your question, it takes five days for a free question to post to the attorney panel that answers LawGuru questions. So your hearings were past before we got this. I hope your niece sorted things out. If she needs an attorney she can contact me for a free initial consulation.
