Parental Rights

To who it may concern..

What requirements are needed to take away parental rights? The father has not been around 7 years now and my wife had a really violent relationship with him and now I want to adopt the child in question but will the court let us do it? He has not had any contact with the child in 7rs and he does not pay child support, my wife never requested it..

Re: Parental Rights

You will need to file a stepparent adoption request with the Superior Court. An investigation needs to be completed by the Department of Social Services prior to the Court approving the adoption. The biological dad must give consent or the petition will be dismissed unless his parental rights are legally terminated. Usually the dad will consent in order to avoid paying child support. If not, a petition is filed to terminate parental rights and the Court decides on that issue before proceeding with the adoption request.
