Legal Question in Family Law in California

I am paying current child support, along with that payment includes back child support. I received a letter from child support services stating that they are going to freeze my account and all assets and remit the funds for my back child support. What I don`t get is that I am paying it with the current child support. What does this mean?

Hello and thank you for your question.

If you are current, with the current and past child support, then they cannot do this.

You can go to the court and have this quashed, or call the Dept. of Child Support Services and have them stop this.

I've seen this happen in Los Angeles County. My question back to you would be whether the arrearages are lump sum, or have you obtained an order to pay back the arrearages at a fixed rate that is included every month in your check to the county? If you have a large lump sum arrearage, and you are simply making payments on it, without an order, the Department of Child Support Services can levy your bank account. If you have an order to make payment on the arrearages, and are current on those payments, then I agree with the answer provided by Ms. Miller.
