Legal Question in Family Law in California

Pending Divorce and Vehicle Reposession

My husband and I bought a truck in April of 2003. At the time I did not yet have my drivers license. In May, same year, he left me for another woman and took the truck with him. Shortly thereafter, he filed for divorce. I never responded to his original petition because we were on speaking terms and I agreed to the terms on the petition. He lost his job and couldn't pay the truck payments on time and fell 3 months behind. The truck was reposessed in early January of this year and it was not mentioned in the original petition. He has still not filed any paperwork to finalize the divorce although I've asked him countless times to please finalize this divorce.

I know the reposession will affect my credit, but what can I do on my part to make it less bad?

Can I still file a response, or should I just file a Petition for Dissolution and start all over?

Please help, I just want to get on with my life.

Thank you,

Tina

Re: Pending Divorce and Vehicle Reposession

If he has not proceeded to judgment the proper method is to file a response. You can then request a trial date to resolve the unresolved issues. Good Luck, Pat McCrary
