Promisory note still valid after spouse comes on title

4 years ago I loaned my son a downpayment for a home. We signed a promisory note to repay plus 1/2 the equity. 2 years ago he was married, my wife and I came off the title and his new wife came on title. They have filed for divorce, his wife's attorney claims we have no legal right to share in her equity, and they will sue for court costs if I persue. I am sure this is not the first time something like this has happened. (Any previous court case history?) Do I have a chance of winning or will I just be out the court costs.
