Legal Question in Family Law in California

Property law ?

I presented an engagement ring to a Fiancee, she accepted my poposal for marriage in February 2002. Six months later she broke off the engagement. there is no chnace of reconcilliation. For the last year I've asked for the ring back, which she will not return. Am I entitled to the ring back and will I be successful in court if I pursue the matter. The rings value is approximatley $5000.

Re: Property law ?

The likelihood is no. It is considered a gift. You may be able to argue that she somehow defrauded you, ie., possibly knew when she accepted that she had not intent of going on. However, it costs you very little to take to small claims and service costs are minimal. Why not.

Re: Property law ?

I strongly disagree with the other attorney's response. The ring was given on a condition and in anticipation of marriage. I've fought this case before. I make no guarantees, but if you hire me, I think I can get that ring back. Yours truly, C.Brainard, Esq. 310-266-4115
