Legal Question in Family Law in California

Question about custody

Trying to make this short. I am involved with someone who has been seperated for some time.. and is now in the process of divorce. He and his wife have a 20 month old son together. She is in California and he is in Texas. He is in the military so that is where he is stationed. My question is what are the odds of him being able to get custody of his son. His wife does not work so he has a much more stable manner of providing income to support the child. However there will be no 'mother' figure so to speak until the divorce is final and I've made the relocation to where he lives.

Is there any chance he could get custody or would it be a waste of money to try?

His odds would be increased if he spends as much time with the child now and has extended visitation. Also if the mother is investigated and fould to be unfit. Call me directly at (619) 222-3504.
