Legal Question in Family Law in California

Can I recover back child support from my father?

I wanted to know if I or my mom can recover child support payments from my father? My mother received little, if any, child support payments from my father when I was growing up. I am 35 years old now and know where my father is. He has not lived with us since I was 1 years old. I never received any money from him. I think my mother took him to court to receive payments but that did not happen.

Is there anyway to get money from him that he owed my mother from when they divorced until I turned 18 years old?

Thank you

If there was a prior court order to pay child support, then the arrearage can probably be collected. Child support that has been ordered and is unpaid accrues statutory interest at the rate of 10% per annum.

I suggest that you consult with an experienced family law lawyer. Experience is not expensive, it's priceless!

It is my understanding that those support arrears that expired due to the passage of time were not revived when the statute was changed to make child support collectable until paid. Contact the local family support office. If you cannot find the number call the district attorney's office, they should be able to give you the telephone number. There is no charge for this service.

Is there a child support order from the court. If so, possibly can collect.
