Legal Question in Family Law in California

Hi there my name is Rick. My father married my step mother 15 years ago. They live in a house that she owned before they got married. He has put over $40,000 into the house, he is 70, and just got over thyroid cancer. Every 6 months or so she gets real mad at him for one reason or another and tells him to get out! He is a very kind man. I dont think he should leave. Does she have the right to pull out the 'Get out!' card on him everytime she gets mad at him??? Its affecting his health. She's very volatile. He and I have a father son project in the back yard, ' outdoor railroad'. I just doesn't seem that she can tell him to leave, not having any real good reason. Thanks

Rick

No, your father has a community intererst in the house. Your father may be able to obtain a restraining order against his wife, or you may be able to become your father's conservator.
