After the party has been served you would need to speak to the other side and ask them for a continuance of the court date. You should then draft up any stipulations and present them to the court for signature as an order. You can speak with the clerks in the court system for some guidance however htey are not allowed to give legal advice.

For self represented individuals you can consult with the family law facilitator self help center at your local court house.

As always please consult a local attorney prior to taking legal action. Good luck. Also please check out my Santa Clara County Family Lawyer blog.
