Legal Question in Family Law in California

My sons father took my son for the summer and agreed to bring him back before school starts but now he won't. He is saying I have to find a way to go get him. And he is not on the birth certificate is that kidnapping?? And we are legally married but he also got remarried.

If your ex is hiding the child, please contact yor local police department to file a criminal complaint. Return to the family courts requesting sole legal and physical custody.
