SSI payments for dependents

After our divorce my ex-husband went on ssi and our dependent kids got checks. Ultimately the kids went to live with the dad so he got thier checks. He then sued me for child support. My question is, can he do that?

Yes, he can petition for a modification to child support even though he and the kids are receiving ssi. However ssi counts as income so it balances in the determination of support.

You may want to consider a modification to custody. Contact a lawyer in your area and run all of the facts by him/her.
