Taking children out of town?

During a custody battle can iether one of the parents take the children out of town or state?

That would depend upon the terms of the current custody order. If no order has been made there is an automatic order, that becomes effective on the petitioner when the summons is issued and the respondent when served with a copy of the summons. This automatic order prevents taking the children out of the state. Your best course of action is to get the other parents consent before taking the children out of town or the state. This consent should be in writing.
